Penal Code 30315 PC – “Are body-piercing bullets illegal in California?”

Criminal defense attorney Neil Shouse discusses California ammunition laws. “Are body-piercing bullets illegal in California?”

More info at https://www.shouselaw.com/ca/defense/penal-code/30315/

Penal Code 30315 PC is the law that makes it illegal to use, or even possess, armor-piercing bullets in the state of California. Gun rights laws such as 30315 PC have been challenged in lower courts over the years, and the issue may someday be decided by the Supreme Court. But at this time, the state law against armor-piercing bullets in California is enforceable, and you can be arrested for this crime if a police officer believes you have used or possessed armor-piercing bullets.

The crime of “possession of armor-piercing bullets” is considered a wobbler. If you are arrested for 30315 PC, you can be charged with either a misdemeanor or a felony. If you are charged with a misdemeanor, you can be sentenced to up to 1 year in jail. If you are charged with a felony, you can be sentenced to up to 3 years in jail or prison.

However, just because you are charged with 30315 PC, does not mean you will be found guilty of that crime. Our attorneys have had a lot of success fighting charges of illegal possession of armor-piercing bullets, and there are several defenses to these charges.

One defense is that you didn’t even realize that the ammunition you possessed was classified as “armor piercing.” Or maybe the ammunition didn’t even belong to you, but the police charged you with it anyway. Sometimes police may even violate your rights with an illegal search and seizure.
